Luật Phòng, chống nhiễm vi rút gây ra hội chứng suy giảm miễn dịch mắc phải ở người (HIV/AIDS) được
ban hành ngày 29 tháng 06 năm 2006. Tại khoản 1 Điều 8 của Luật đã quy định nghiêm cấm hành vi kỳ
thị, phân biệt đối xử đối với người nhiễm HIV nhưng trên thực tế sự kỳ thị phân biệt đối xử vẫn còn diễn
ra tại cộng đồng. Sử dụng nghiên cứu cắt ngang để đánh giá nhận thức và thực hiện Luật, cũng như đánh
giá thực trạng việc kỳ thị phân biệt đối xử trong cộng đồng đối với người nhiễm HIV sau 8 năm thi hành
Luật. Kết quả cho thấy tỷ lệ người nhiễm HIV/AIDS biết về Luật và quyền của họ là 58,8% cao hơn so
với tỷ lệ trong cộng đồng là 23,8%. 51,2% người dân không cho người nhiễm HIV được chơi với trẻ em,
43,8% không mua thực phẩm của người nhiễm HIV. 70,4% người nhiễm HIV cảm nhận bị cộng đồng xa
lánh, 33,8% cho biết không được mời đến các sinh hoạt cộng đồng (đám cưới, đám ma, lễ hội). Kết quả
nghiên cứu cho thấy cần tiếp tục tăng cường truyền thông về pháp luật Phòng chống HIV/AIDS để tăng
cường nhận thức của người dân, bảo đảm quyền và lợi ích hợp pháp cho người nhiễm HIV, tạo điều kiện
cho họ được sống hòa nhập
Summary:
Law on HIV/AIDS prevention and control was
passed in June, 29th 2006. Item 1 of Article 8 of
this Law stipulated that stigma and discrimination
against people living with HIV is prohibited.
However, the stigma and discrimination is still
very hard in the community. Using crosssectional
study to assess the awareness and
implementation of the Law, as well as assess
the status of the stigma and discrimination in the
community for people living with HIV after 8
years of implementation of the Law. The results
showed that the proportion of people living
with HIV/AIDS known the Law and their
rights was 58.8%, higher than the proportion
in the community (23.8%) 51.2% of people
in the community said that people living with
HIV was not allowed to play with kids; 43.8%
of them would not buy foods which was
provided by people living with HIV. 70.4% of
people living with HIV were isolated by the
community, 33.8% of them were not invited to
community events (weddings, funerals, festivals
etc). The study results indicated that it is necessary
to strengthen the communication of Law on HIV/
AIDS prevention and control, to strengthen the
awareness of the citizen, to protect the rights and
legal beneficiaries of people living with HIV
and to create a good condition for them to live
integration with the community and society.
